you know at the end of chapter 35 kaname says i would be happy born as her real older brother
does that mean that kaname is adopted?

The Kaname that we know it the manga right now is I think a clone of some kind. The real Kaname died when he was a child. At least that's what I have heard.

The original Kaname's soul is replaced with the soul of a Kuran ancestor by Rido, Kaname's and Yuuki's uncle (yes, therefore Shiki, Rido's son, is their cousin). The original Kaname's soul is considered dead. Because Rido was the one who revived him, Rido is now considered as the current Kaname's master and therefore cannot kill him.
